Are YOU ready for Alberta's New Distracted Driving Law (Bill 16)?


It's been a long time coming.  Starting September 1st, 2011, the new Distracted Driving Legislation, (Bill 16) will make it unlawful to drive distracted in the province of Alberta.  So what constitutes "distracted driving"?  According to the Government of Transportation website, distracted driving includes:

·         Hand held cell phone usage

·         Texting or emailing

·         Using laptops, video games, cameras and videos

·         Inputting info into GPS devices

·         Writing, printing or sketching

·         Personal grooming

·         Reading printed materials in the vehicle.

This new bill is a "complement" to the current "driving without due care and attention" legislation and includes all vehicles including bicycles! Moreover, this bill is relevant to all urban and rural areas of the province and the fine will cost you $172.00!  Yikes!!

In the case of drivers who are pet owners, if you are pre-occupied with a pet while you're driving, the police officer may argue that being distracted by your pet is comparable to the bans listed above and can he or she can charge you! 

Also, did you know that Traffic Safety Act 115(2)(i) is in the current legislation and allows police officials to charge a driver who allows anything (including a pet) if said object interferes with your ability to access your vehicle controls and impedes the safe operation of your vehicle?

Furthermore, Traffic Safety Act 115(2)(i) gives police the ability to charge a driver who allows anything (including a pet) to obstruct the driver's vision in any direction at any given time. 

In addition, if you get caught driving distracted under the new Distracted Driving Legislation, AND violated the provision in the Traffic Safety Act listed above; the police officer has the option to charge you with violating one or all of the laws above.
